European Funds

In addition to the traditional funds that form part of the EU Multiannual Financial Framework 2021-2027, in the forthcoming years Spain is set to receive a total further amount of €140 billion from various European instruments –in particular, from the Next Generation EU recovery plan instrument–, for the purpose of making investments and reforms that enable a two-pronged transition –ecological and digital– of the Spanish economy, as well as strengthening economic, social and territorial cohesion and equal opportunities, within the framework of the European Single Market.

The mobilisation of this enormous volume of financial resources, half of which will arrive in the form of direct transfers (the other half being granted in the form of loans), in addition to entailing a significant management challenge for public authorities and bodies, will constitute an unprecedented opportunity for companies to develop investment projects.

What do we do?

(·) Strategic, legal and financial advice in relation to the requirements that must be met by the projects eligible for grants financed with European funds in the light of the applicable EU/national framework and the most appropriate public-private partnership solutions for their implementation.

(·) Tracking of legal developments (EU, national or regional) in relation to European funds, development instruments of the Spanish Recovery, Transformation and Resilience Plan (Plan de Recuperación, Transformación y Resiliencia) and the invitations to apply for grants financed with European funds of the various public authorities.

(·) Monitoring of Projects for Economic Recovery and Transformation (Proyectos Estratégicos para la Recuperación y Transformación Económica – PERTE) and advice in relation to the registration of companies interested in PERTEs in the central state register (or in its relevant section) and the activities that may be carried on by them after their registration.  

(·) Legal and financial advice in relation to the drawing-up of projects eligible for grants financed with European funds and the preparation of the necessary documentation for being able to receive them.

(·) Advice in relation to the conclusion of public-private partnership agreements or the incorporation of public-private partnership instruments (business groupings with or without legal personality, consortiums or institutional public-private partnerships) necessary for implementing projects eligible for grants financed with European funds.

(·) Legal advice and defence in relation to any incidents that may occur during the conducting of the procedures for awarding grants financed with European funds.

(·) Advice in relation to the implementation of projects benefiting from grants financed with European funds, including the preparation of supporting evidence to justify the subsidised activities.

(·) Legal and financial advice in relation to the functioning of the public-private partnership instruments required for the implementation of projects eligible for grants financed with European funds.

(·) Legal advice and defence in relation to the subsidy and grant audit and inspection proceedings that may be opened (including possible repayment and infringement proceedings).

Our team
